The theory behind punishment in the classical naturalise is that it was a necessary evil. It is sometimes required to deter equity violators from repeating their offensive activity and to serve as an example to others who would immoderately violate the law. I believe this is where the law that there should be no cruel or unusual punishment is derived from. If you commit a small crime you will get minimal punishment. However, if you commit a serious crime you will receive a harsh punishment, equal to the crime.



This punishment, no matter how big or small, will hopefully deter you from ever committing the crime again.
In my opinion, I believe that the punishment of criminals should be based dually on their mortal characteristics and the crime that was move. Both areas need to be looked at to give a fair punishment to any individual. I believe that every criminal case is different from the next. If an individual has committed several offenses, some very serious, gets committed of a small crime such as illegal obstinance of a gun, he should get punished to the full period of the law.
